Unless you’ve been living under a rock, you probably are aware that our neighbors, New Jersey, have legalized recreational marijuana. That means that anyone and everyone can make their way to a New Jersey dispensary and purchase marijuana products. Pretty exciting stuff! But, can I bring legal weed from New Jersey into Pennsylvania? Good question! The answer may surprise you. Let’s take a deeper look at what you can and cannot do with weed you legally buy at a dispensary in the great state of New Jersey.

Unfortunately the short answer is, No, you cannot bring weed purchased legally in New Jersey back to Pennsylvania. Marijuana is still federally illegal so crossing state lines while in possession is illegal. Even if you have a Pennsylvania medical marijuana card, you cannot purchase weed in New Jersey and bring it back to Pennsylvania. 

With that being said, marijuana is decriminalized in many municipalities in PA, including Philly. Possession of under 30 grams is not a criminal offense and only carries a small fine. If you ask many PA residents, they will tell you that they go to New Jersey for their weed all the time and come back just fine. But again, it’s still technically illegal. 

So, what can you do if you just want to buy some weed? Well, there are a few options. First off, you could acquire a medical marijuana card and visit Pennsylvania dispensaries. To qualify for a medical marijuana card you must have one or more of the qualifying conditions set by the state. This ranges from simple anxiety, to cancer, to HIV, and much more.

You can visit the PA commonwealth website for a full list of qualifying conditions. You will need to speak with a doctor who will approve you for a medical marijuana card. Then you need to pay the state a small fee. Then you will get your medical marijuana card in the mail and can visit the state’s dispensaries. 

Another option is to go to New Jersey and purchase recreational marijuana. Even out-of-staters can purchase marijuana products at New Jersey dispensaries. But, as we mentioned above, you are technically not allowed to travel across state lines with the weed you just purchased.

That does not stop tens of thousands of people from doing exactly this. It is a pretty common practice, however, we cannot legally recommend you do this method.

Another option would be to purchase legal hemp-derived THC products. THC derived from hemp was legalized in 2018 under the Farm Bill. It is a loophole that allows marijuana products to be sold with a legal classification of hemp. Although the legal definition differs, marijuana and hemp-derived THC products are exactly the same. You can find dispensary grade flower, edibles, drinks, and more all outside of the dispensary.

You can even shop for these products online. The best part is, there is no legal limit to how much hemp you can possess and you can travel across state lines with it because it is federally legal.
